Revision of the Low Dollar Threshold for Medicare Beneficiaries




Although CMS  previously required MSAs for total settlement values of $10,000 and above, this policy changed with the following memo, increasing the new review threshold to $25,000.

The original threshold was outlined in the memo dated July 11, 2005, specifically Question 2 .

The change was made to deal with workload and was not to be considered a "safe harbor" threshold.
As always, Medicare's interests always need to be considered in WC settlements.
