Medicare Secondary Payer and Associated Fees
Centers for Medicare and Medicaid Services (CMS) issued a memo to clarify some of the previous concerns about commutation of future benefits and to address changes to previous memos including attorney and administrative fees associated with MSAs.
Essentially, administrative and attorney costs specific to the MSA would no longer be charged to the MSA. All payment for such costs must be completely separate from the MSA funds.
