Not so clever MSA marketing
Crowe Paradis proudly trumpets that they use a lawyer on every MSA. Maybe redirecting one of their staff to review their latest marketing campaign would be a better idea. The terms “trademark infringement” and “likelihood of confusion” kind of jump right off the page at me.
Go to Google and type in the keyword MEDVAL. Here is what you will see.

Some not so bright sales/marketing type thought it would be a good idea to try to redirect customers searching for MEDVAL to the Crowe Paradis website instead. I guess they hoped to snare a few unwitting prospective customers to their website using a classic bait and switch. I don't know, it seems to me someone searching for MEDVAL that ends up on the Crowe Paradis page would realize something was amiss. Like I said, this idea probably wasn't hatched by a Harvard law grad.
Hey, I don’t mind if they copy my business model and claim it as their own. I can live with them starting a blog and incessantly posting their propaganda on every LinkedIn group John Routhier manages to join and not get censured by the administrator. I don’t take offense to them starting a professional administration company and pretending to have nothing to do with it, while filing a patent application for an idea that has existed for years. I even support them coming to my blog 831 times this past year* to get ideas for their newsletter and to learn a little something about the MSP. It’s a popular spot for a lot of MSP vendors.

But I draw the line at USING MY NAME FOR THEIR ADVERTISING. I could use one of my nurse/attorneys to write a cease and desist letter, but they are busy working on cases, just like they have been doing since 2003, but I won’t. Instead, I will let your 832nd visit to the blog serve as notice to stop your blatant trademark infringement.

PS : As of 1:00pm EST the transgression has been fixed. Thank you. Now I don't have to spend the weekend hiring an offshore firm to click on the ad a million times and blow your whole internet marketing budget.









FYI. Just went to Google and typed in MEDVAL. It appears to have been fixed…
